This Agreement is between RE/MAX Real Estate Group("Broker"), and the site visitor("User") as entered in the name field on the Registration Section above.

In consideration for services to be performed by Broker and Agent, User grants to Broker the right to act as User's real estate agent under the following terms.

1. User asserts that he or she is a bona fide buyer or seller of real estate;

2. User has not signed any agreement with a real estate agent or agency that would prevent User from entering into this Agreement with Broker and, at the present time, USer is not working with another real estate agency on a formal basis;

3. User agrees that his or her initial search price range is within User's general area of affordability;

4. User agrees to abide by all copyright restrictions placed o an the content of the RE/MAX Estate Group site including, but not limited to, any material or data compilations where the copyright is held by Broker or others;

5. User agrees that any electronic or printed copies of property listings or other content from this site("Site Materials"), will be for User's sole and exclusive use and that User will not attempt in any manner to recommercialize, sell or otherwise distribute such Site Materials;

6. User agrees that he or she will not contact the seller of any property introduced to User by Broker, nor will User attempt to gain access to a property or speak with an owner unless through an appointment set by Broker;

7. User acknowledges that when physical home tours (property showings) commence, User will be requested to enter into (sign) a hard copy written Buyers Agency Disclosure, Buyer Representation Agreement that will replace this Agreement;

8. User agrees that, unless otherwise agreed upon, Broker will compensate by the Listing Broker or by the Owner of the Property;

9. Broker shall: a) use diligence in maintaining current content of the MLS data on Broker's site; b) provide assistance requested by User having any difficulty in locating suitable properties within User's Home Criteria or in navigating Broker's site; and c) use Broker's best efforts to procure for User requesting a property viewing, an appointment to show such property to such User who has entered into the BUyer's Agency Disclosure that will replace this Agreement;

10. User agrees that RE/MAX Real Estate Group represents User as a Buyer's Agent and that User is a client of RE/MAX Real Estate Group;

11. User agrees that RE/MAX Real Estate Group may also represent other prospective buyers seeking to purchase properties that may meet User's criteria;

12. User agrees to avoid the use of profanity, expletives, derogatory comment or any terms or phrases that discriminate based upon race, color, sex, religion, handicap, familial status or national origin in any communications on or through this site;

13. User agrees to use this site at his or her own risk. If the use of this site or the materials therein results in the need for servicing or replacing property, material, equipment or data, Broker is not responsible for those costs;

14. User agrees that Broker and/or it's suppliers will not be liable for any direct, indirect, incidental, special or consequential damages arising out of or in any way connected with the use of this site or with the delay or inability to use this site, or for any information, products, and services obtained through this site , or otherwise arising out of the use of this site, whether based on contract, tort, strict liability or otherwise, even if Broker or any of its suppliers has been advised of the possibility of damages;

15. User agrees that the information, software, products, and services published on the RE/MAX Real Estate Group site may include inaccuracies or typographical errors. User understands that Broker is providing this site and its contents on an "as is" basis without warranty of any kind. Broker and/or its respective third-party providers reserve the right to modify the contents of this site without notice;

16. User agrees that this site contains hyperlinks to web sites operated by parties other than Broker. Such hyperlinks are provided for your reference only. Broker is not responsible for their contents nor in any way does the hyperlink imply that Broker endorses the material on such web sites or any association with their operators;

17. This Agreement will commence when User selects the "I Agree" button and enters User's name and e-mail address in the spaces provided above (Commencement data). User can extend the term of this Agreement without loss of portfolio information by renewing his Terms of User Agreement prior to its termination;

18. This Agreement will terminate without notice to either party at the earlier of: a) 60 days of inactivity; b) User's entering into a written Exclusive Right To Purchase or Lease, Buyer Representation Agreement with Broker.
